brainboost GmbH (”brainboost”, “bb”, “we”, “us”, and “our”), provides a software platform to facilitate neurofeedback training with engaging content and related activities for trainers such as documentation of training improvements and invoice creation.

The BrainAssistant platform allows to write down, upload, post and document information about the user (trainer) and clients.

There may be questions about what are permitted and prohibited uses of our platform. We have created this Content and Use Policy (the “Policy”) to provide additional clarification on activity and content which is prohibited and/or subject to additional restrictions on the platform where additional agreements (Business Associate Agreements) may be obligatory.

The following activities are prohibited:

• Illegal activities: You may not use the Services to encourage, promote, facilitate or instruct others to engage in illegal activity.
• Graphic and harmful content. You may not use the Services to post, upload, share, store, or otherwise distribute content that is graphically violent or obscene, sexually explicit, promotes self-harm, promotes terrorist activity, promotes misinformation, or otherwise poses a threat to the public.
• Harassment, bullying, defamation and threats: You may not use the Services to facilitate abusive, harassing, or bullying behavior.
• Hateful content: You may not use the Services to promote, encourage, support or facilitate hate speech, violence, or discrimination based on race, color, sexual orientation, marital status, gender or identity expression, parental status, religion or creed, national origin or ancestry, sex, age, physical or mental disability, veteran status, genetic information, citizenship and/or any other characteristic protected by law. Organizations or individuals who do any of the above either through their own content or through the distribution of user generated content (whether intentionally distributed or distributed due to the failure to reasonably moderate such content) are prohibited from using the Services.
• Intellectual property: You may not use the Services to misappropriate or infringe upon anyone’s intellectual property rights.

The following activities are prohibited without acknowledging further liabilities of Customer and brainboost in a Business Associate Agreement

Customer acknowledges and agrees to be solely responsible of the Customer Data. Customer further warrants to protect third-party rights and to obtain the necessary consent under applicable law if inserting third-party party data. Customer will bind Users by law to comply with the required data protection and non-disclosure of the respective data.

• Avatars: The BrainAssistant allows you to create avatars, i.e., profiles for trainers and trainees. Training sessions are stored including the selected trainer and the selected trainee. Our Cloud Sync service synchronizes avatars and related documentation when using our platform on several devices. These profiles can be either generated in a pseudonymous or identifiable way.
• Personal and confidential information: Some modules of the BrainAssistant will allow to post, upload, share, or store content. Customer may not post, upload, share, or store content or otherwise use the services in manner that is invasive to another’s privacy or otherwise violates or compromises another person’s legal rights - such as rights of privacy and publicity, including sharing another’s personally identifiable information, sensitive personal information, or confidential information without the appropriate consent and complying to applicable laws. A Business Associate Agreement regulating Customer’s and brainboost’s responsibilities is obligatory when posting, storing or otherwise processing third-party data and/or sensitive data in the Services.
